Supervision Best Practices for 2026

This moderated discussion is designed for Managing Principal Brokers implementing their supervisory responsibilities under HB 3137.

Under the updated law, MPBs are responsible for establishing and enforcing written policies, procedures, and systems to:

• Review and manage the professional real estate activities of brokers
• Review and manage the use of disclosure forms and contracts
• Manage document filing and storage
• Manage the handling of trust funds
• Oversee the use of unlicensed assistants by associate brokers
• Educate associated brokers on federal, state, and local real estate laws
• Review documents that may materially affect the rights or obligations of a party to a transaction
• Ensure all associated licensees hold active licenses before conducting professional real estate activity.

MPBs must also establish a system for monitoring compliance with statutes, administrative rules, and brokerage policies.

This forum will focus on how brokerages are structuring and enforcing these required supervision systems in 2026.
